Rights and freedoms guaranteed under the Human Rights Act 1998

The Human Rights Act 1998 guarantees the following rights and freedoms set out in the European Convention of Human Rights.

Article 2: The right to life

Article 3: Prohibition of torture (freedom from torture, inhuman or degrading treatment or punishment)

Article 4: Prohibition of slavery and forced labour

Article 5: Right to liberty and security (the right not to be unlawfully detained)

Article 6: Right to a fair trial

Article 7: No punishment without law (freedom from retrospective penalties)

Article 8: Right to respect for private and family life (including right to home and correspondence)

Article 9: Freedom of thought, conscience and religion (including right to change religion or belief and freedom to manifest religion or belief in public or private)

Article 10: Freedom of expression (including freedom to receive and impart information without interference)

Article 11: Freedom of assembly and association (including the right to form and join trade unions)

Article 12: Right to marry (right for men and women to marry and found a family)

Article 14: Prohibition of discrimination (the right not to be discriminated against in the enjoyment of the Convention rights and freedoms on any ground such as sex, race, colour, language, religion, political or other opinion, association with a national minority, property, birth or other status)

Please note that there is no Article 1 (in the Convention, Article 1 is “The state shall secure the right”) or Article 13 (“The right to an effective remedy”) because the Government considered that, in introducing the Human Rights Act, it had secured Articles 1 and 13.
